A bill of lading is the corner stone of international carriage of goods by sea since it is a negotiable document which has three separate but inter-linked functions. The aim of this short session is to provide the fundamental knowledge of bills of lading, both theoretical and practical. The participant will be able to understand the functions of a bill of lading, cargo claims that might arise and rights of suit at both common law and statute. This involves the application of general principles of English commercial law, principally being an application of the law of contract, tort and bailment, to the specific field of the carriage of goods by sea. Legislation will be also examined.
Upon completion the participant will be able to:
  • Understand the differences between Charterparties and Bills of Lading;
  • Learn the functions and the Types of Bills of Lading;
  • Understand the differences between the actual and the contractual Carrier;
  • Learn what a Bill of Lading should contain as a document;
  • Learn what are the legal right of the holder of the Bill of Lading.
  • Understand the critical role and practices for the bills of lading, and
  • Identify and analyze critical issues related to Bills of Lading.
The course consists of one session.
